Understanding Burglary Charges in Illinois

A burglary conviction carries harsh penalties, so our attorneys will research your case to establish whether a burglary actually occurred. According to 720 ILCS (Illinois Compiled Statute) 5/19-1, a person commits burglary when without authority he or she knowingly enters or remains in a building, trailer home, watercraft, aircraft, motor vehicle, railroad car, or any part thereof, with intent to commit a felony or theft. In simple terms, under Illinois law, the intent to steal must be proven before it can be considered a burglary.

Burglary is considered a Class 2 felony, and is punishable by three to seven years in prison and up to $25,000 in fines. In some cases, depending on where the alleged crime was committed, burglary can be a Class 1 felony, which carries tougher penalties than a Class 2 felony. There are exceptions and if they exist in your case, we can find them for you. Our attorneys will prepare and pursue an aggressive defense on your behalf to give you the best possible outcome.
